Our mission is to help people get active and achieve their fitness goals. To accomplish this, we develop a platform that allows users to have a personalized workout experience, track their activity, encourage one another, and earn rewards. This Privacy Policy outlines how we use the data that you provide. This Privacy Policy applies to our website located at https://www.updowntech.com (the “Site”) and to our mobile applications (the “Apps”). The Site and the Apps are collectively referred to as (the “Service”). By using the Updown Service you consent to this Privacy Policy and that we may process the data that we collect from you in accordance with this Privacy Policy.

In this policy, the terms “we,” “us,” “our,” and “Updown” refer to Updown Technologies, Inc. The terms “you,” “your,” and “yours” refer to the end user using the Service.

This Privacy Policy may periodically change. Any future changes will not affect data that was collected under a previous version of this policy. If any modification substantially changes your rights, we will use reasonable efforts to notify you of the change.

Data We Collect

When You Create an Updown Account
In order to use the Updown Apps, you must create an Updown account. When you create an Updown account, we ask for some personal information, including your email address and date of birth. Your email address will be your Updown account ID, and you will use this to log into your account. We do not display your email address to other users.

When You Add Information to Your Account
You can customize your Updown experience by adding other types of information to your account, such as entering a workout, adding a photo to your profile, or sending messages to friends. We collect this information as you add it and store it in your Updown account.

When You Sign Up for a Premium Account
When you sign up for a premium account, you submit your credit card information, billing address, and shipping address. We do not view or store your credit card and billing address information as this is handled by our third-party payment processor. Your shipping address is used by third-party rewards providers to facilitate the delivery of rewards. We limit the personal information provided to third-party providers to that which is necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of the information.

When You Use the Service
When you use or interact with the Service, we may use a variety of technologies such as cookies, mobile device identifiers, and SDK integrations that collect information about how the Service is accessed and used. This information may include:

1. Information about your interaction with the Service, such as interactions with various pages;
2. Details of queries you make and the date and time of these requests;
3. Information you post to the Interactive Service, as defined in the Terms of Service, such as comments you post;
4. Technical data, which may include URL information, cookie data, your IP address, the types of devices you are using to access the Service, device ID, device attributes, network connection type, network and device performance, browser type, language, operating system, and Updown application version;
5. Metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts and address book information.

Sending Messages
Although we require a login for users receiving messages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Service with whom you may choose to share your messages. Therefore, we cannot and do not guarantee that your messages will not be viewed by unauthorized persons.

Information Collection and Tracking Technologies. In addition to the information collected above, we may use the following technologies for automatic information collection:
  • Cookies (or mobile cookies or browser cookies). A cookie is a small file placed on your smartphone or hard file of your computer. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. It may be possible to refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our App or Site.
  • Web Beacons. Pages of the App and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages [or opened an e-mail] and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

How We Use Your Data

Updown uses your data to provide you with the best possible experience, to keep you informed about new features, and to improve our Service.
  • Age, gender, and workout data you submit are used by Updown to build targeted workouts that will best meet your needs
  • Contact information is used to send you notifications about the latest features so that you can best use Updown for your needs. You may opt out of receiving communication from Updown.
  • Analytics cookies enable us to optimize the Updown Service
  • Functional cookies enable us to improve your experience by remembering your login session, your settings, and other features which are in line with choices you’ve made for your Updown Service
  • De-identified data that does not identify you may be used to inform the fitness and health community about trends, for marketing use, or for sale to interested third parties.

What Data May be Shared with Third Parties

Updown does not sell any data that could identify you. We may share de-identified and aggregated data or data that you direct us to share. We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Data That Could Identify You
Personal information is data that could identify you such as your name, email address, or other data that could be reasonably traced back to you. We will only share personal information under the following circumstances:
  • When it is necessary to share this information with companies who are contractually obligated to provide us with services such as credit card processing and reward delivery. These companies are required by contract to maintain the security of any personal information they receive from us.
  • If we believe that disclosure of this data is required to comply with the law or when it is in our interest to protect the security of our property or other legal rights or to protect the rights or property of others, or otherwise to help protect the safety or security of our Service.
  • We may disclose or transfer your personal information in connection with the sale, merger, bankruptcy, sale of assets or reorganization of our company. We will notify you if a different company will receive your personal information, and the promises in this Privacy Policy will apply to your data as transferred to the new entity.

De-identified Data
Updown may share or sell aggregated, de-identified data that does not identify you. When we provide this information, we perform appropriate procedures so that the data does not identify you, and we contractually prohibit recipients of the data from re-identifying it back to you.

Data That You Direct Us to Share
We may share data with other parties at your direction. For example, you might authorize us to link your Updown account to your Facebook. Once you direct us to share data with a third party, that data is governed by the third party’s privacy policy. You can revoke your consent to share data with a third party at any time in your Updown account settings.

How Long We Save Your Data

We store your personal information for as long as you maintain an Updown account. If you cancel your Updown account, your personal information data will be removed from our server. Updown may continue to use and share your de-identified data after you deactivate your account.

You may edit or remove data that you provide to your Updown account. If you remove data, it will no longer appear to you or others who use the Updown service. Backups of that data will remain associated with your Updown account on our archive servers.

Security of Data

Updown strongly values the security of your data and uses both technical and administrative controls to maintain the security of your data. No data security measures can be guaranteed to be completely effective, and as such we cannot ensure or warrant the security of any information that you provide to us.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. [We urge you to be careful about giving out information in public areas of the App like message boards. The information you share in public areas may be viewed by any user of the App.]

Policy for Children

Updown is not intended for use by anyone under the age of 13. We do not knowingly collect any personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@updowntech.com.

Your California Privacy Rights

California Civil Code Section 1798.83 permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to support@updowntech.com.

Data from International Users

Our Services are hosted and operated entirely in the United States and are subject to United States law. Any personal information that international users provide to Updown is being transferred to Updown for use solely in the United States. The United States does not have the same data protection laws as other regions. By providing personal information to Updown, you consent to the transfer of it to the United States and the use of it in accordance with this policy and applicable law.

Changes to Our Privacy Policy

We may update our privacy policy from time to time with or without notice. If we make material changes to how we treat our users' personal information, we will post the new privacy policy on this page with a notice that the privacy policy has been updated.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for periodically visiting this privacy policy to check for any changes.
